Palphone — End User License Agreement (EULA)

1) Scope of License

Subject to your compliance with this EULA and the Terms of Service, PROSHOT PTY. LTD. (the “Licensor”) grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Palphone mobile application (the “App”) on devices you own or control, as permitted by the platform usage rules (Apple App Store / Google Play).

This EULA governs App use only. The Terms of Service also apply and, if there is a conflict, the Terms control except where platform usage rules require otherwise.

2) Platform Terms & Third-Party Beneficiaries

Apple Inc. and Google LLC (and their subsidiaries) are third-party beneficiaries of this EULA and may enforce it to the extent required by their platform rules. Your use of the App must comply with the current Apple Media Services Terms and Conditions and Google Play Terms of Service.

3) Restrictions

• No reverse engineering, decompilation, disassembly, or attempts to derive the source code, except as permitted by law.
• No copying, distribution, renting, leasing, selling, sublicensing, or making the App available to third parties, except as allowed by platform family sharing/volume purchasing rules.
• No removal of copyright, trademark, or other proprietary notices.
• Use must comply with the Acceptable Use rules.

4) Updates, Maintenance & Support

Licensor may provide updates or patches at its discretion and is responsible for App maintenance and support. Platform operators have no obligation to provide support for the App.

5) Privacy & Data

Use of the App is subject to our Privacy Policy. Chats are end-to-end encrypted (E2EE); files and public voice feeds are not E2EE. Chats are deleted after delivery; files after download or after 7 days if undownloaded. Profile data and public voice posts persist as outlined in the Privacy Policy. 6) User Content & Copyright Liability

You retain ownership of your content. However, you are solely and legally responsible for any voice recordings, captions, tags, or other content ("User Content") you publish on Palphone, including full compliance with copyright, trademark, and intellectual property laws. You represent that your content does not infringe upon any third-party rights.

You grant us a limited, worldwide, royalty-free license to host, cache, transmit, and display your content solely to operate the Service (e.g., routing messages/files, hosting public feeds, and security checks).

7) Intellectual Property

The App and all related intellectual property are owned by PROSHOT PTY. LTD. or its licensors. All rights not expressly granted are reserved.

8) Content Moderation, Ad Restrictions & Termination

We reserve the absolute right, at our sole discretion, to monitor, refuse, remove, or permanently delete any User Content (including public voice posts) or suspend/terminate any user account at any time, for any reason or no reason, without prior notice, justification, or liability. Users explicitly agree they have no right to object, appeal, or claim compensation regarding such actions.

Commercial advertising, promotions, or marketing activities by users are strictly prohibited unless explicitly approved in writing by the Licensor.

This EULA is effective until terminated. Your rights end automatically if you breach it. Upon termination, stop using the App and delete copies. Account-level consequences are governed by the Terms of Service.

9) Warranty & Liability Disclaimer

The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties. PROSHOT PTY. LTD. shall not be liable for any damages resulting from system hacks, unauthorized access, data leaks, or breaches. Your use of the App is at your own risk, as further described in the Terms of Service.

10) Governing Law & Dispute Resolution

Dispute resolution, governing law, and jurisdiction are governed by the Terms of Service (including the informal resolution requirement—30 days for consumers; 180 days for business users with tolling—regional carve-outs, and U.S. arbitration/no class actions).

11) Changes

We may update this EULA. Material changes will be announced in-app or on our site with the new “Last updated” date. Continued use means acceptance.

12) Anti-Harassment

There is zero tolerance for objectionable content, harassment, or abusive users. Any user engaging in such behavior will have their account terminated immediately.
