1. Overview

Welcome to Palphone (the “Service”). By using the Service, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

The Service is operated by PROSHOT PTY. LTD. (the “Company”). These Terms incorporate any additional policies referenced in-app or on palphone.com.

2. Eligibility

  • The Service is for adults 18+. By using it, you confirm you are at least 18.
  • We do not present an in-app age prompt, but the 18+ requirement applies.
  • If we learn a user is under 18, we delete the account.

3. Account

  • No phone number or email is required to create an account.
  • You may choose a display name, avatar, and optional profile fields. We do not verify profile information.
  • You are responsible for securing your device and any in-app PIN.

4. Palnumber (in-app virtual number)

  • On request, we may assign you a Palnumber. It works only inside Palphone so people can find and call you in-app. It is not a public telephone, PSTN, or mobile number.
  • Expiry: If there is no activity for 90 days, the Palnumber expires and may be reclaimed.
  • Do not mislead anyone into believing a Palnumber works outside Palphone.

5. Messaging & Files

  • Chats are end-to-end encrypted (E2EE).
  • Files and public voice feeds are not E2EE.
  • Ephemeral storage: Chats are deleted from servers after delivery. Files are deleted after download, or after 7 days if not downloaded. Public voice posts persist until deleted as outlined in the Privacy Policy.
  • Because of this design, we generally cannot retrieve delivered messages or deleted files.

6. Safety & Moderation

  • Automated checks of profile and bio images via AWS Rekognition to detect policy violations (for example nudity or violence).
  • Manual human review may apply to bio videos.
  • Public Voice Feed Moderation: Community reports and automated moderation tools filter public recordings and text.
  • Files and messages exchanged in private chats are not scanned by us.
  • Use in-app tools to block or report users or content.

7. Acceptable Use

Do not break laws; infringe intellectual property; post illegal content (CSAM strictly prohibited); harass, threaten, or incite violence or hate; run scams, phishing, or spam; interfere with security; or use automated means without permission. Unapproved commercial advertising or marketing activities are strictly prohibited. We may remove content, restrict features, or suspend or terminate accounts for violations.

8. Content Moderation, Ad Restrictions & Termination

We reserve the absolute right, at our sole discretion, to monitor, refuse, remove, or permanently delete any User Content (including public voice posts) or suspend/terminate any user account at any time, for any reason or no reason, without prior notice, justification, or liability. Users explicitly agree they have no right to object, appeal, or claim compensation regarding such actions.

Commercial advertising, promotions, or marketing activities by users are strictly prohibited unless explicitly approved in writing by the Company.

9. Subscriptions & Purchases (if available)

  • Certain features (for example Silver/Gold) may be paid.
  • Billing is processed by the Apple App Store and/or Google Play.
  • Auto-renewal applies unless you cancel as described by the store.
  • Refunds follow the app store policies for your jurisdiction. In the event of account suspension due to policy violations, no refunds will be provided.

10. Intellectual Property & Copyright Liability

You retain ownership of your content. However, you are solely and entirely responsible for any voice recordings, text, or files you publish. You represent and warrant that your content does not violate any copyright, trademark, or proprietary rights of third parties. PROSHOT PTY. LTD. assumes no legal or financial liability for user-generated content.

You grant us a limited, worldwide, royalty-free license to host, cache, transmit, and display your content only to operate the Service (for example routing messages or files, hosting public feeds, and running security checks). The Service software and brand are owned by the Company and its licensors.

11. Service Changes & Availability

We may add, remove, or modify features, and may suspend the Service for maintenance, security, or legal reasons. We are not liable for outages, ephemerality-related data loss, or third-party failures.

12. Disclaimers & Limitation of Liability (Security Breaches & Hacks)

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties.

While we implement administrative, physical, and technical safeguards to secure the platform, you acknowledge that no electronic transmission or storage system is entirely secure. To the maximum extent permitted by applicable law, PROSHOT PTY. LTD. shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of, or resulting from, unauthorized system access, cyber-attacks, hacking, data leaks, or the unauthorized disclosure, distribution, or publication of user data. By using the Service, you accept these risks and waive any right to object, bring claims, or pursue legal action against the Company in connection with a security breach.

Our total liability for any other claim is limited to the amount you paid us in the last 12 months (or USD $100 if none), except where prohibited by law.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising from your misuse of the Service, your User Content, or your breach of these Terms or laws.

14. Dispute Resolution & Governing Law

Informal resolution first: Before filing any claim, email legal@palphone.com with a description of the dispute and allow 30 days for informal resolution. The limitation period is tolled during this 30-day period. Requests for urgent injunctive relief (for example IP or security issues) are exempt.

Business accounts (non-consumer): The informal resolution period is 180 days, and any limitation period is tolled during that time.

  • Global default (except carve-outs): UAE law governs; the courts of Dubai have exclusive jurisdiction. Urgent IP or security matters may be brought in Dubai courts for injunctive relief.
  • Australia: For users in Australia, Victoria law governs; the courts of Victoria have exclusive jurisdiction.
  • EU/EEA & UK: Consumer users may bring claims in their country of residence, and mandatory consumer protections apply. Business use falls under UAE law and Dubai courts.
  • United States — Binding Arbitration & No Class Actions: Disputes are resolved by individual binding arbitration (AAA Consumer Rules, governed by the FAA). Hearings may be remote or in the county of your residence. Class, collective, or representative actions are not permitted. Either party may use small-claims court instead of arbitration. Opt-out: email legal@palphone.com within 30 days of first accepting these Terms (subject: “Arbitration Opt-Out”). IP or security injunctive claims may be brought in court.

Time limit: To the extent permitted by law, claims must be filed within 1 year after they arise; otherwise they are permanently barred.

15. Changes to Terms

We may update these Terms periodically. Material changes will be notified in-app or on our site with a new “Last updated” date. Continued use means acceptance.
